Welcome to BeforeUKick.com.  Before U Kick, Inc. provides website features and other products and services to you when you visit, shop, or inquire at/from BeforeUKick.com, use BeforeUKick.com services (camps, instruction, or third party products). Before U Kick, Inc. provides BeforeUKick.com Services subject to the following conditions.

By using BeforeUKick.com Services, you agree to the following conditions.

BeforeUKick.com offers kicking and punting instruction through mini-camp and a camp format. All personal instruction, though offered through Before U Kick, is completely exempt from any legal liability. When you use a Before U Kick Service you also be subject to the guidelines, terms and agreements applicable to that Before U Kick Service (“Service Terms”). If these Conditions of Use are inconsistent with the Service Terms, those Service Terms will control.

Please review our Privacy Policy, which also governs your use of Before U Kick Service, to understand our practices.

Electronic Communications

When you use any Before U Kick service, or send e-mails, text messages, or other communication from your desktop or mobile device to us, you are communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, text messages, and/or written forms of communication. The communications can be saved for your records. You agree that all agreements, notices, disclosures, and other forms of communications that we provide to you electronically or in written form satisfy any legal requirements that all such communications be in writing.

Copyright

All content included in or made available through any Before U Kick Service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of Before U Kick or its content suppliers and protected by United States and international copyright laws. The compilation of all content included or made available through any Before U Kick service is the exclusive property of Before U Kick and is protected by U.S. copyright laws. All recommended resources located on the Personal Growth page of www.beforeukick.com or the property of and subject to their respective owners, who may or may not be affiliated with, connected to, or sponsored by Before U Kick.

Trademarks

Before U Kick is a registered trademark or trade dress of Before U Kick, Inc. in the United States. The Before U U Kick trademark or trade dress may not be used in connection with any product or service that is not Before U Kick’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Before U Kick. All other trademarks not owned by Before U Kick that appear in any Before U Kick Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Before U Kick.

Camp Registration and Camp Size

In order to ensure and maintain the highest quality coaching standards (athlete-to-coach ratio), Before U Kick may limit the number of athletes to any given camp to ensure the maximum quality of time and attention given to each individual athlete.

Camp Participation, Scheduling, & Pro-Rated Pricing

All Before U Kick Camps have a schedule and curriculum to accomplish within the camp timeline. Those choosing to attend only part of a camp will be charged on a pro-rated basis. Partial attendance to a 1-Day or Mini-Camp will be charged according to the time (per hour) of being in physical attendance to that camp. Partial attendance to a multi-day camp will be charged according to the practices (per practice) of being in physical attendance to that camp. All partial camp payments must be paid in advance of the camp and by check (personal, business, cashiers, or money order).  All fully attended camps must be paid in advance and in full through the www.beforeukick.com credit card option or by a check (personal, business, cashiers, or money order) and mailed to: Before U Kick PO Box 151253 Alexandria, VA 22315.

Full and active camp participation require that each athlete be in the required “physical athletic shape” in order to fully participate in the physical nature of the camp. This “physical athletic shape” is to occur prior to the attendance or participation with any Before U Kick Camp. Each athlete has the sole responsibility to disclose and any all physical conditions, limitations, injuries, ailments, or allergies that may prove to be a liability or could be aggravated throughout or during the duration of the camp – each camp will have measured repetitive movements that are designed to teach and reinforce the instruction of kicking and punting. In addition, it is the sole responsibility of the athlete to report any new injury or awkward condition that may lead to an injury to a member of the coaching or training staff immediately.  At the time of new injury or awkward condition, all “active” participation should be ceased immediately by the athlete in the camp.

Camp Refunds

Prior to registering and paying for any Before U Kick Camp it is the sole responsibility of “you” the customer to verify their schedule for any potential future conflicts that may arise for which Before U Kick is not responsible. All camp refunds are handled on a case by case basis. There will be a mandatory $100 charge for all camp refund requests. All refunds will be paid by check to the address provided by “you” the customer. All medical requests (due to an injury prior to attendance at a Before U Kick camp) for camp refunds will also be subject to a minimum $100 mandatory charge.

Limitation of Liability

All athletes choosing to participate in any Before U Kick camp are required to complete an Emergency Medical Release form. This form releases Before U Kick from any and all medical expenses incurred by the athlete as a result of any and all injuries incurred by the athlete while in participation at a Before U Kick camp. All Before U Kick camps are designed to equip the athlete to better participate and perform their skill should they continue their disciplined training on an ongoing basis after the conclusion of the camp. The success of the athlete is the success of the athlete. The inability to obtain a certain level of success or future recognition is therefore the full responsibility of the athlete as well. Before U Kick, its coaches, partners, or affiliates are therefore not responsible, legally or otherwise for any lack of success or unachieved performance for which there is no guarantee past, present, or future.
